A WEST Midlands Police firearms officer is being investigated for potential homicide offences after the fatal shooting of Sean Fitzgerald in Coventry on January 4, 2019.
The criminal probe has been launched as part of the investigation by the Independent Office for Police Conduct (IOPC) into Mr Fitzgerald’s death.
‘Homicide’ offences cover both murder and manslaughter.
He died from a single gunshot wound to the chest as he exited a property in Burnaby Road and was unarmed at the time he was shot.
The IOPC started its investigation after a mandatory referral from the force.
IOPC Regional Director Derrick Campbell said the complex probe was nearing its conclusion.
“Following a review of all of the evidence obtained and the receipt of legal advice, we have revisited our position on potential criminal conduct.”
He added it did not mean criminal charges would necessarily follow but, at the end of the IOPC’s examination, it will decide whether or not to refer it to the Crown Prosecution Service.
The officer and Mr Fitzgerald’s family have been informed and, Mr Campbell said, the IOPC’s thoughts remain with all those affected by his death.
